By visiting the https://althr.my website or using altHR applications (the website and applications are collectively being referred to as “App”) operated by Digi Telecommunications Sdn Bhd (“DIGI”), you are accepting and agreeing to comply with the Terms.
The English language version of the Terms shall prevail, in the event that there is any discrepancy between this version and versions translated into other languages. DIGI reserves the right to amend and adapt the Terms, the latest valid version of which can be viewed on the https://althr.my website, at any time. Continuing to use the App after the Terms have been changed will imply that you have irrevocably accepted the new version. You have the option at any time not to start or continue to use the App if you do not accept the Terms in the version in force when it is used.
As long as you respect the Terms, DIGI grants you a non-exclusive, non-transferable and revocable licence to use the App.
All rights relating to the App and its content, as well as its functionalities, (1) are the exclusive property of DIGI (particularly intellectual rights connected to its design as well as its development, source code, copyright and trademarks, hereinafter referred to as the “Intellectual Rights”); (2) are protected by the applicable international and national legal provisions; and (3) are under no circumstances transferred in full or in part within the context of the licence to use the App.
By using the App, you undertake to respect DIGI’s Intellectual Rights, as well as those generally owned by anybody else, including in particular, not to copy, forward, download or share content without obtaining the necessary rights to do so. In the event that you breach any of these undertakings, DIGI will be entitled to remove the content in question and suspend or cancel your licence to use the App without notice or compensation.
Any suggestion that you pass on to DIGI to adapt or improve the App may be used by DIGI free of charge, irrevocably and without any conditions.
DIGI can adapt and add functionality to the App or remove some of them without the need to inform you of this in advance or to offer you any compensation.
You can stop using the App when you choose to, without any right to receive a refund of any value whatsoever.
DIGI can at any time, without the need to give a reason, notice or compensation, terminate, suspend or limit your licence to use the App. Unless we tell you otherwise, upon any termination, (1) the rights and licenses granted to you in the Terms will end; and (2) you must stop using the App, and (if needed) delete it from your device. In the event that the Terms are breached, DIGI may take such action as it deems appropriate including bringing legal proceedings against you.
The suspension or cancellation of the licence to use the App will mean that you will no longer have any access to your data, without you having any recourse against DIGI.
You are responsible for the information that you pass on to DIGI with a view to them granting you a licence to use the App. You confirm that it is correct and you undertake to pass on any modifications to DIGI.
You are fully and exclusively responsible, without any recourse against DIGI, for using the App and any consequences of that use.
Specifically, you are responsible for the confidentiality of any codes and passwords allowing you to use the App, and access to your information as well as this use and this access by any third party, whether or not they are authorised by you.
In particular, you undertake (1) not to abuse your use of the App; (2) not to disrupt or interrupt use of the App by one or more users; (3) not to make the App available to third parties via unauthorised distribution channels; (4) not to use the App if you are below the minimum age required, which is 13 or more in some countries; (5) not to publish or share content that is obscene, pornographic or that incites sectarianism or religious, racial or ethical hatred; (6) not to break the law in any way, including in particular by storing, publishing or sharing content that is fraudulent, defamatory, deceptive or infringes on other people’s privacy or rights; (7) not to knowingly introduce viruses or other malicious or harmful material or using it in connection with unsolicited communications; and (8) not to use the App in a way that may damage or impair the App or DIGI’s underlying systems and security.
You are responsible to understand that DIGI will not be held responsible for any security or privacy compromises for any jailbroken devices.
DIGI is under no circumstances responsible for (1) use of the App by the users, whether that is you or third parties to whom you have voluntarily or involuntarily given access to your information; and (2) for the consequences of this for each of them and for third parties.
If the App relates to a publication or an exchange of information or content between users, DIGI will under no circumstances be responsible for the content published and shared, which it is not bound to control.
The App, including all content on or available through the App, is provided on an ‘as is’ basis and we do not make any representation or give any warranty in respect of the App or any of its content. The content of the App is not intended as advice and should not be relied upon. Specifically, without this list being exhaustive, it does not guarantee that the App does not contain any programming or other errors, that it meets all the expectations of every user, that it will not be the subject of any malfunctions, that use will never be interrupted or not possible, that it can be used in any location, that there will be no loss of content or any other information, that it is suitable for a particular use or that there will never be any problem transferring or saving data.
DIGI does not promise that it will always update the App so that it is relevant to you and/or works with the iOS/Android version that you have installed on your device. However, you promise to always accept updates to the application when offered to you.
As a result of this, neither DIGI nor any of its employees, subcontractors, suppliers or distributors, will have to provide any compensation to anybody (whether or not they are users) if there are any direct or indirect damages (e.g. damages for loss of earnings or profit) resulting in particular from one of the circumstances described in the previous paragraph.
DIGI collects various information and details of a personal nature whenever you use the App. This information includes the following: surname, first name, postal address, email address, landline or mobile telephone number, photo, IP address, browser and device used, website from which you were redirected to the DIGI website, all the identifying details of your devices, geolocation details etc.
Your information is collected by DIGI to enable provision services by DIGI via the App and for DIGI’s internal use (statistics, direct marketing, database updates etc.) and in order to analyse and optimise how the App is used. It is protected and is not passed on to third parties, including in particular advertisers, unless (1) your permission has been given beforehand; (2) to deal with imminent danger; (3) to respond to an order from the legal authorities; or (4) to protect the rights of DIGI as well as those of other users.
If the licence to use the App has been granted by DIGI to your employer, the latter may at any time have access to your information.
You can turn off cookies in your browser or remove stored cookies, but this may limit your ability to use the App.
By using the App, you consent to our collection and use of your personal information, in the manner described in our Privacy Notice.
The App has a functionality whereby personal information or files are stored on its servers (emails, contacts, files, content, photos, identification numbers, passport numbers, bank account details, etc.) as well as being published and shared.
This information and these files belong to you, subject to third party intellectual property rights that you must respect by not copying, forwarding, downloading or sharing anything without their prior consent.
It is your decision whether you share your information and files as well as being your sole responsibility, not that of DIGI, who is under no circumstances responsible for the content of the information and files that are published and shared.
Your personal information and files are protected and DIGI cannot disclose their content unless there is an imminent danger, to respond to an order from the legal authorities or to protect the rights of DIGI as well as those of other users.
You may be charged by your service provider for downloading and/or accessing the App on your mobile phone, tablet or other device (“Device”). These may include data roaming charges if you do this outside your home territory. All these charges are solely your responsibility. If you do not pay the bills for your Device then we assume that you have permission from the person that does before incurring any of these charges.
You agree that DIGI can contact you by any means, whether electronic or not, with information about the App or other products developed or marketed by them and, to this end, you undertake to keep your contact details up-to-date.

Any dispute between DIGI and you will be referred to the exclusive jurisdiction of the courts of Malaysia. The Terms and any dispute or claim arising out of or in connection with them will be governed by the laws of Malaysia.
You cannot transfer to anybody else the rights and responsibilities resulting from the licence to use the App, which is granted to you by DIGI. If DIGI does not call for the application of one or more clauses of the Terms, this cannot be interpreted as their relinquishment of the right to demand that it is applied.
